Where I can find information on the laws of Australia, in relation to indecent exposure?
Ok, this may seem strange and sordid, but Please read and see what I'm trying to find out. It is the feminist movement "topfreedom" I'm looking for a school assignment. I need to know (From a State Department official) about the laws in Australia (or at least in southern New South Wales) to indicate whether actually illegal for women to be topless / topfree in public. In particular, I want to know whether special laws that apply to the beaches, parks, etc. where women are not allowed to do so completely. * On a side note, Topfreedom equality agenda is not about sex. It is simply a movement that "gives women the right to be in public topfree where men have this right. "Helping women say they want the right to be Topfreedom topfree in public, not only because men can, but breastfeeding tanning comfort and other practical purposes
Here is a copy and paste the relevant legislation: Article 5 of the Crimes Act 1988 (NSW): 4 offensive behavior (1) A person must not behave in an offensive manner or near, or vision or hearing, a public place or in school. Maximum penalty: 6 penalty units or imprisonment for three months. (2) A person does lead in an offensive manner referred to in subsection (1) only using offensive language. (3) is a sufficient defense to an offense under this process section if the accused before the court that the defendant had a reasonable excuse for driving himself as alleged role in the cessation of the infringement. The courts say that what is "offensive" is a question of what is reasonable in time, place and circumstances. Therefore, it might be offensive behavior to lead without facing children in an elementary school, but could not be offensive to behavior climb the stairs to free isolated beaches. Similarly, it could be a public urination aggressive behavior in Pitt Street, Sydney at lunchtime on Monday, but would not be aggressive to urinate in a public walking track branches Katoomba. Good luck.
